Measures for Yunnan Province to Implement Several Opinions on Strengthening Service and Supervision of Market Subjects by Using Big Data
According to the requirements of Several Opinions of the General Office of the State Council on Strengthening the Service and Supervision of Market Subjects by Using Big Data (Guo Ban Fa [2015] No.51), combined with the actual situation in our province, these Measures are formulated.
I. General requirements
Fully implement the spirit of the 18th National Congress of the Communist Party of China and the 2nd, 3rd, 4th and 5th Plenary Sessions of the 18th National Congress, according to the decision-making arrangements of the CPC Central Committee and the State Council, strictly in accordance with the national top-level design requirements, and in combination with the "Cloud on the Cloud" action plan of our province, focus on making the market play a decisive role in resource allocation and better play the role of the government, promote decentralization and transformation of government functions, and take the construction of social credit system, government information disclosure and data disclosure as the starting point. Make full use of modern information technologies such as big data and cloud computing, improve the level of government services, strengthen supervision after the event, maintain normal market order, promote fair competition in the market, release the vitality of market players, and promote the use of big data in our province to achieve new breakthroughs and the construction of social credit system to a new level.
Second, the main objectives
Efficient collection, effective integration and application of government data and social data to enhance the effectiveness of government services and supervision; Strengthen the supervision of market players during and after the event, promote decentralization and the transformation of government functions, establish a cross-regional and multi-sectoral credit linkage reward and punishment mechanism, and promote market players to operate in good faith according to law; Improve all-round services to market players, and continuously reduce the cost of government services and supervision; Through the openness of government information and data, and the open sharing of social information resources, we will build an all-round market supervision system.
Third, the task
(1) Use big data to improve the service level for market players. Make full use of big data technology, actively provide more targeted services in registration, market access, government procurement, etc., and innovate government service concepts and service methods. We will effectively implement the unified social credit code system for citizens, legal persons and other organizations, comprehensively implement the reform of the registration system of "three certificates in one" and "one photo and one yard" for industrial and commercial business licenses, organization code certificates and tax registration certificates, improve the working mechanism of three-level linkage approval and parallel approval of investment projects, accelerate the construction of the online service hall for administrative examination and approval in the province, and strive to go online before the end of 2015 to improve the efficiency of registration and administrative examination and approval. Government departments are encouraged to use websites and emerging media such as Weibo and WeChat to improve the level of information services. Establish and improve the incentive mechanism of trustworthiness, and implement "green channel" support incentive policies such as giving priority to those who are honest and trustworthy and simplifying procedures. Strengthen statistical monitoring and data processing services. Guide professional organizations and industry organizations to use big data to improve services. Use big data to evaluate the performance of government services and improve the effectiveness of governance and services of governments at all levels and their departments.
(2) Using big data to strengthen and improve market supervision. Build a big data supervision model and improve the post-event supervision mechanism. Establish and improve the credit commitment system. Based on the pilot project of social credit information system, accelerate the establishment of a unified credit information sharing and exchange platform. Establish and improve the joint disciplinary mechanism for dishonesty. Establish product information traceability system. Strengthen market supervision in the field of e-commerce. Use big data science to formulate and adjust regulatory systems and policies, evaluate them regularly and adjust them as needed. Promote the formation of an environment and mechanism for the whole society to participate in supervision.
(3) Promoting the open sharing of government and social information resources. Further strengthen the openness of government information and data. Unless otherwise stipulated by laws and regulations, information such as administrative license and administrative punishment should be made public on the Internet within 7 working days from the date of making an administrative decision, so as to improve the transparency of administrative management and the credibility of the government. Accelerate the construction of "Credit Yunnan" website, and vigorously promote the publicity of market subject information. Actively promote the exchange and sharing of information within the government, except as clearly stipulated by laws and regulations, the application for the establishment of new departmental information systems, where the demand for information sharing between departments is not clear, will not be approved; The department information system under construction, which can not share information with other departments, shall not pass the acceptance; Any departmental information system that does not support the construction of credit information sharing platform in Yunnan Province and does not provide information to the credit information sharing platform in Yunnan Province shall not be approved or accepted.
We will promote the open sharing of information resources in the whole society in an orderly manner, and form a big data resource with interactive integration of government information and social information.
(4) Improve the government’s ability to use big data. Strengthen the construction of e-government and improve the level of government information. Establish and improve the government big data collection system, strengthen and standardize government data collection. Explore the establishment of a catalogue of government information resources and establish a management system of government information resources. Strengthen the standardization and classified management of government information, and reasonably set the scope of government information disclosure. Strengthen cooperation between the government and enterprises, and promote the government to purchase big data resources and technical services from social forces.
(5) Actively cultivate and develop socialized credit information service. Support deep cooperation between credit reporting agencies and government departments, enterprises and institutions, social organizations, etc., and promote credit reporting agencies to establish credit records of market entities. Encourage credit reporting institutions to carry out professional credit reporting services, and further expand the application of credit reports in administrative management and public services, banking, securities, insurance and other fields. Vigorously cultivate and develop the credit service industry and further improve the market credibility and social influence of the credit service industry.
(6) Improve safeguard measures and strengthen organizational leadership. Promote collaborative integration and innovation of big data and enhance industrial support capabilities. Establish and improve the management system and handle the relationship between big data development, service, application and security. Establish a big data standard system and improve standards and specifications. Strengthen network and information security protection. Improve the talent training system for big data technology, management and service, and strengthen the construction of talent team. Effectively strengthen the organization and leadership of the use of big data and clarify the division of responsibilities. Closely combine the reality, highlight the key points, and integrate data resources to provide services for society, government and enterprises.
Fourth, the division of responsibilities
(a) the implementation of citizens, legal persons and other organizations unified social credit code system.
Responsible units: Provincial Development and Reform Commission, Commission Office, Public Security Department, Civil Affairs Department, Kunming Central Sub-branch of People’s Bank of China, Provincial State Taxation Bureau, Local Taxation Bureau, Industrial and Commercial Bureau and Quality Supervision Bureau (the first department is the lead department, the same below).
Time requirement: completed according to the national unified deployment schedule.
(two) the full implementation of the industrial and commercial business license, organization code certificate and tax registration certificate "three certificates in one", "one photo and one yard" registration system reform.
Responsible units: Provincial Administration for Industry and Commerce, Quality Supervision Bureau, State Taxation Bureau, Local Taxation Bureau and Development and Reform Commission.
Time requirement: implementation before the end of December 2015.
(3) Build an online examination and approval supervision platform for investment projects with information sharing and covering the whole province, establish a transparent, standardized and efficient vertical and horizontal linkage cooperative supervision mechanism for investment projects, and realize "unified acceptance, synchronous review, information sharing and transparency and openness" for cross-departmental and cross-level project examination and approval and filing, and accelerate the construction of an online service hall for administrative examination and approval in our province.
Responsible unit: Provincial Development and Reform Commission, led by the provincial government supervision office; Provincial Commission for Industry and Information Technology, Department of Finance and other departments to cooperate.
Time requirement: completed before the end of June 2016.
(four) to promote government departments to integrate relevant information, closely combine the needs of enterprises, and use websites and emerging media such as Weibo and WeChat to provide services for enterprises.
Responsible unit: Provincial Commission of Industry and Information Technology, Network Information Office and relevant departments.
Time requirement: continuous implementation
(five) to study and formulate policies and measures for the use of credit information and credit reports in the process of financial subsidies, government procurement, government procurement services, and government investment project construction bidding.
Responsible unit: Provincial Department of Finance, Development and Reform Commission
Time requirement: It shall be formulated by classification according to the management requirements of various special funds.
(6) Make full use of big data technology, improve economic operation monitoring and forecasting and risk early warning, strengthen platform construction, and timely release relevant information to the society to reasonably guide market expectations.
Responsible unit: Provincial Development and Reform Commission and Statistics Bureau.
Time requirement: continuous implementation
(7) Support professional service organizations such as banks, securities, trusts, financial leasing, guarantees and insurance, and industry associations and chambers of commerce to use big data to provide services for enterprises.
Responsible units: Kunming Central Branch of the People’s Bank of China, Yunnan Banking Regulatory Bureau, Yunnan Securities Regulatory Bureau, Yunnan Insurance Regulatory Bureau, and Provincial Civil Affairs Department.
Time requirement: continuous implementation
(8) Improve the post-event supervision mechanism, collect and integrate relevant data, make good use of the big data supervision model, and improve the government’s scientific decision-making and risk prediction capabilities.
Responsible unit: each market supervision department.
Time requirement: achieve phased results before the end of June 2016.
(nine) in the process of handling administrative licensing and other links to establish a comprehensive credit commitment system before market participants enter. Credit commitments are made public to the public and included in the credit records of market entities.
Responsible unit: competent departments of various industries
Time requirement: the pilot project will be widely carried out in 2016 and completed before the end of December 2017.
(ten) to speed up the construction of state, city and various departments of credit information sharing and exchange platform, credit information system departments and industries, through the province’s unified credit information sharing and exchange platform to achieve interconnection and sharing.
Responsible unit: the people’s governments of all prefectures and cities, and relevant departments directly under the provincial level.
Time requirement: completed before the end of December 2016.
(eleven) establish and improve the joint punishment mechanism for dishonesty, and embed the use of credit information and credit reports in all fields and links of administrative management and public services as necessary conditions or important reference. Establish cross-departmental linkage response and breach of trust restraint mechanisms in various fields. Establish a "blacklist" system for various industries and a market exit mechanism. Promote the applicant’s good credit status as a prerequisite for various administrative licenses.
Responsible unit: provincial departments, state and municipal people’s governments.
Time requirement: achieve phased results before the end of December 2015.
(12) Establish a product information traceability system, strengthen the supervision and management of important products such as food, medicines, agricultural products, daily consumer goods, special equipment, products protected by geographical indications, establish a product quality traceability system by using information technologies such as the Internet of Things and radio frequency identification, and form an information chain with traceable sources, traceable whereabouts and accountability.
Responsible units: Provincial Department of Commerce, Network Information Office, Food and Drug Administration, Agriculture Department, Quality Supervision Bureau, Industry and Information Technology Commission.
Time requirement: It will be issued and implemented before the end of June 2016.
(thirteen) to strengthen the supervision and management of e-commerce platform, strengthen the collection and analysis of e-commerce information, guide the development of e-commerce website trusted certification services, promote the application of website trusted logo, and promote the construction of e-commerce trusted trading environment. Improve the rights protection and dispute mediation mechanism.
Responsible unit: Provincial Administration for Industry and Commerce, Department of Commerce, Network Information Office, Industry and Information Technology Commission.
Time requirement: continuous implementation
(fourteen) to further increase the openness of government information and data. Unless otherwise stipulated by laws and regulations, the information such as administrative license and administrative punishment shall be made public on the Internet within 7 working days from the date of making an administrative decision.
Responsible unit: provincial departments, state and municipal people’s governments.
Time requirement: continuous implementation
(fifteen) to speed up the implementation of the business exception list system and the list system of serious illegal and untrustworthy enterprises. Make full use of the enterprise credit information publicity system, publicize the basic credit information such as enterprise registration, administrative license and administrative punishment, as well as the annual report of the enterprise, the list of abnormal business operations and the list of serious illegal and untrustworthy enterprises according to law, and realize organic docking and information sharing with the unified credit information sharing and exchange platform in the province.
Responsible unit: Provincial Administration for Industry and Commerce, relevant departments directly under the provincial level, and people’s governments of various states and municipalities.
Time requirement: continuous implementation
(sixteen) to support the exploration and development of socialized credit information publicity services. Build the website of "Credit Yunnan", collect and integrate the credit information held by various localities and departments that should be made public, realize one-stop inquiry of credit information, and facilitate the society to understand the credit status of market participants. The websites of the state and municipal people’s governments and their departments should be connected with the website of Credit Yunnan, and the public information of government affairs of this unit and the illegal information of relevant market entities should be made public on the website of Credit Yunnan.
Responsible units: Provincial Development and Reform Commission, Kunming Central Sub-branch of the People’s Bank of China, relevant departments directly under the province, and people’s governments of various states and municipalities.
Time requirement: completed before the end of 2016.
(seventeen) to promote the interconnection and information exchange and sharing of information systems built and under construction in various States, cities and departments. In the approval and acceptance of departmental information system projects, the requirements for information sharing will be further strengthened.
Responsible unit: Provincial Development and Reform Commission, provincial departments concerned.
Time requirement: continuous implementation
(eighteen) improve the e-government network in Yunnan Province, accelerate the construction of the province’s government information project, co-ordinate the establishment of population, legal entities, natural resources and spatial geography, macroeconomics and other information resources, and accelerate the construction and improvement of the province’s important information systems.
Responsible unit: Provincial Development and Reform Commission, provincial departments concerned.
Time requirement: it will be implemented in years and basically completed by the end of 2020.
(nineteen) to strengthen the record of relevant information of market participants, and form a credit file.
Market entities that are seriously illegal and untrustworthy shall be included in the "blacklist" in accordance with relevant regulations, and relevant information shall be included in the enterprise credit information publicity system and the unified credit information sharing and exchange platform in the province.
Responsible unit: provincial departments concerned.
Time requirement: implemented before the end of June 2016.
(twenty) to cooperate with the state to explore the establishment of government information resources directory.
Responsible unit: provincial departments concerned.
Time requirement: to cooperate with the national progress.
(twenty-one) to guide the credit reporting institutions to strengthen the innovation of credit service products according to market demand, and further expand the application of credit reports in administrative management and public services, banking, securities, insurance and other fields.
Responsible units: Provincial Development and Reform Commission, Kunming Central Branch of People’s Bank of China, Yunnan Banking Regulatory Bureau, Yunnan Securities Regulatory Bureau and Yunnan Insurance Regulatory Bureau.
Time requirement: achieve phased results before the end of December 2017.
(twenty-two) the implementation of fiscal, taxation, finance, industry, talent and other policies to support the development of big data industry, vigorously support the innovative application of big data related technologies and products, and promote the accelerated development of big data industry.
Responsible units: Provincial Development and Reform Commission, Industry and Information Technology Commission, Finance Department, Human Resources and Social Security Department, Kunming Central Branch of the People’s Bank of China, Provincial Network Information Office, Yunnan Banking Regulatory Bureau, Yunnan Securities Regulatory Bureau and Yunnan Insurance Regulatory Bureau.
Time requirement: achieve phased results before the end of December 2017.
(twenty-three) strict implementation of the national standard e-government, supervision of cross-border information flow, protection of national economic security, information security, and protection of business secrets and personal privacy management system.
Responsible units: Provincial Commission of Industry and Information Technology, Network Information Office, Public Security Department, Industry and Commerce Bureau, Development and Reform Commission, Legislative Affairs Office.
Time requirement: it shall be implemented in accordance with the relevant laws, administrative regulations and systems formulated by the state.
(twenty-four) to promote the introduction of relevant local regulations, government regulations and normative documents in our province, and to make provisions on the use of credit information and credit reports by government departments in administrative management and public services, so as to provide a basis for joint punishment of illegal and untrustworthy behaviors of market participants.
Responsible unit: Provincial Development and Reform Commission, Kunming Central Branch of the People’s Bank of China, and Provincial Legislative Affairs Office.
Time requirement: It will be promulgated before the end of December 2017 (local regulations, government regulations and normative documents will be formulated in accordance with procedures).
(25) In accordance with the big data standard system established by the state and the basic standards, technical standards, application standards and management standards related to big data, do a good job in connecting the technical standards of government information collection, storage, disclosure, sharing, use, quality assurance and safety management in our province with the state. Implement standards and norms that guide information sharing and exchange among enterprises, and promote the development and utilization of information resources.
Responsible units: Provincial Commission of Industry and Information Technology, Development and Reform Commission, Quality Supervision Bureau, Network Information Office and Statistics Bureau.
Time requirement: Implement according to the national promotion steps.
(twenty-six) to promote the implementation of big data demonstration and application projects, and take the lead in carrying out demonstration and application projects in the fields of industrial and commercial registration, statistical investigation, quality supervision, safety production supervision, competition law enforcement, and consumer rights protection to realize the convergence and integration of big data. Implement big data demonstration and application projects in the fields of macro management, tax collection, resource utilization and environmental protection, food and drug safety, safe production, credit system construction, health care, labor security, education and culture, transportation and tourism, financial services, small and medium-sized enterprise services, industrial manufacturing, modern agriculture, trade and logistics, comprehensive social management, and income distribution adjustment.
Responsible units: Provincial Development and Reform Commission, Industry and Information Technology Commission, Network Information Office and relevant departments.
Time requirement: achieve phased results by year before 2020.
V. Relevant requirements
States, cities and relevant departments should attach great importance to the use of big data to strengthen the service and supervision of market players. In accordance with the requirements of these Measures, we should promptly formulate specific work measures to promote the extensive and in-depth use of big data in the service and supervision process. Provincial Development and Reform Commission is responsible for the overall coordination, tracking, supervision and inspection of the implementation of these measures to ensure that all tasks and measures are put in place.
